Terms and conditions

Upon selecting a program, kindly familiarize yourself with the terms and conditions as your booking is governed by these stipulations. Any payment towards a reservation for a Magical Cusco Travel Agency program or tour implicitly agrees to all provisions in the Booking Terms & Conditions outlined here and applies to all tours.

In general:

  • The program itinerary may vary due to weather and river conditions or to accommodate the preferences of the group. Magical Cusco Travel Agency is not liable for any loss or damage to the personal belongings of the client or any resulting implications from such loss or damage.
  • Responsibility for any illness or accident that may occur rests solely with the client, including all related costs. Equipment lent to clients must be returned in its original condition; compensation for any damage or loss incurred will be expected upon return to Cusco.
  • It is the client’s responsibility to declare their physical and mental fitness. Magical Cusco Travel Agency will not assume any liability for any adverse outcomes if this proves untrue.
Reservation Procedures

Ensure to reach out to us before proceeding with any payment. To secure your chosen program, a non-refundable deposit of 50% per person is required at the time of booking. By making this payment, you enter a contractual agreement with MAGICAL, upon which we accept and confirm your reservation. Please note, bookings are only deemed confirmed when explicitly stated in writing by Magical Cusco Travel Agency.

This 50% pre-payment can be made via Western Union, PayPal, or online transactions, payable in the name of a Magical Cusco Travel Agency staff member. Please note, Magical Cusco Travel Agency does not cover any bank charges or transfer costs; these expenses must be borne by the client.

Final Payment Procedure

All program prices are quoted in U.S. dollars. We require the final balance to be paid at our office at least 24 hours prior to your tour. Currently, we accept cash (in Peruvian soles or American dollars) and Visa (which incurs an 8% commission charge). The agreed-upon price per person, confirmed at the time of booking, remains constant and will not fluctuate.

Cancellation Procedure

Should you need to cancel, please notify Magical Cusco Travel Agency in writing. Bear in mind that the deposit is non-refundable. Provide the reason for cancellation as you may be eligible for coverage under your insurance policy.

If we receive your cancellation notice more than 15 days before departure, you will forfeit your 50% deposit. If cancellation is made between 15 to 7 days before departure, 50% of the tour price will be refunded only if the full payment was made in advance. If the cancellation is made less than 48 hours before departure, or if only part of the tour is cancelled, no refund will be issued.

Amendments / Alterations by Us

Unforeseen circumstances such as technical issues, weather conditions, strikes, civil unrest, or governmental decisions can arise.

In these scenarios, Magical Cusco Travel Agency will propose viable solutions to carry out the program or equivalent travel plans, however, we will not offer refunds. We reserve the right to adjust the proposed itinerary as necessary. Although changes might occur, we commit to making reasonable efforts to deliver the confirmed program.

Significant alterations, if feasible, will be communicated to you before departure. Alternative arrangements of similar value will be proposed. Any ensuing additional expenses will be the responsibility of the client. It is important to note that Magical Cusco Travel Agency is not obliged to cover additional expenses incurred by the client in tour preparation, such as international tickets, visa fees, immunizations, and so forth.

For cancellations directly caused by Magical Cusco Travel Agency, a full refund of your payment will be issued.

Risk Acknowledgment

Certain itineraries of Magical Cusco Travel Agency are curated to expose participants to the authentic environment of the visited sites. As such, they carry inherent personal risks, possibly resulting in physical or emotional harm, paralysis, death, property damage, or harm to third parties. The client acknowledges these risks as an intrinsic part of the tour and willingly assumes them. The client avows awareness of his/her physical and health conditions and, with this understanding, elects to undertake these risks. Magical Cusco Travel Agency is thereby absolved from any liability associated with any accident or injury that might occur.

On-Tour Authority

The company’s guide or representative possesses ultimate authority on all matters that could potentially compromise the safety or welfare of the tour group. Adherence to the guide’s instructions is mandatory at all times.

The client must consistently comply with the laws and drug regulations of Peru. Failure to do so, or any actions jeopardizing the group’s welfare, may result in the guide or company representative ordering the client’s immediate departure from the tour, without any form of refund.

Documentation for Travel

Clients must possess a valid passport. An original or a copy must be carried during the tour.

Insurance for Travel

We highly recommend obtaining travel insurance. It should cover accidents, medical costs, emergency repatriation—including rescue and air ambulance services. It is also advisable to ensure coverage for  cancellations and loss of luggage.

Services Provided by Third Parties

While Magical Cusco Travel Agency directly operates some parts of our services included in a program, we also collaborate with airlines, hotels, and other independent entities to provide the travel services you purchase. We take all reasonable measures to ensure that these organizations uphold our quality standards. However, these entities are independent suppliers over which we do not have complete direct control.

Therefore, Magical Cusco Travel Agency cannot accept liability for any loss, damage, inconvenience, or delay.

Addressing Grievances and Claims

If a client has a complaint against the company, the guide should be informed during the tour so that immediate steps can be taken to resolve the matter. Any additional complaints must be submitted in writing to the company within seven days following the end of the tour.

All claims or disputes will be handled exclusively in Cusco, Peru. Courts here, applying Peruvian law, will have exclusive jurisdiction.

Claims for damages against Magical Cusco Travel Agency will be capped at the value of the disputed item. Any liability is restricted to the total amount paid for the tour. In all cases, the company expressly excludes liability for indirect, incidental, or consequential loss or expense, including loss of profits.
